Terms & Conditions

1. Acceptance & eligibility

By downloading, accessing, or playing Dodgeye (the “Game”), you agree to these Terms & Conditions and to our Privacy Policy. If you do not agree, do not use the Game. You must be at least 13 years old (or the minimum age of digital consent in your country). If you are under the age of majority where you live, you may use the Game only with the involvement of a parent or legal guardian who agrees to these Terms.

2. Licence to play

Dodgeye grants you a personal, limited, non-exclusive, non-transferable, revocable licence to download and play Dodgeye for your own private, non-commercial entertainment, on devices you own or control. All rights not expressly granted are reserved. You may not sell, rent, sub-licence, or commercially exploit the Game or any part of it.

3. Your account

You can play instantly as a guest, or sign in with Apple or Google to save and sync your progress. You are responsible for activity under your account and for keeping your sign-in credentials secure. Accounts are for one person and may not be shared, sold, or transferred. If you choose a public username for leaderboards, it must not be offensive, misleading, infringing, or impersonate another person or brand — we may change or reclaim usernames that break these rules.

4. Fair play & prohibited conduct

Dodgeye is a game of skill, and fair competition matters. Our servers replay and validate submitted runs, and we may use automated and manual systems to detect abuse. You agree that you will not:

• Cheat, or use bots, scripts, automation, macros, or modified or unofficial clients.
• Tamper with, intercept, or manipulate game data, network traffic, scores, currency, or leaderboards.
• Exploit bugs or glitches for advantage instead of reporting them, or circumvent our anti-cheat, fairness, or security measures.
• Reverse-engineer, decompile, or disassemble the Game, except to the limited extent this cannot be restricted by law.
• Access our servers or APIs in any unauthorised way, or place unreasonable load on our infrastructure.
• Harass other players, or use the Game for anything unlawful, harmful, or infringing.

We may reject or reset scores that fail validation or appear fraudulent, and we may take action on accounts involved in violations (see Suspension & termination).

5. Virtual items & currency

Dodgeye includes in-game items such as coins, blob skins, trails, trophies, and stars. These are earned by playing — the Game is not pay-to-win, and there is no way to buy a competitive advantage. Virtual items and currency:

• are licensed to you for use within the Game only, and remain our property;
• have no monetary value, are not real currency, and cannot be redeemed for cash;
• are not transferable or sellable outside the Game; and
• may be adjusted, expired, or removed as we develop and balance the Game.

You do not own virtual items, and you have no right to a refund of them except where required by law. If we introduce optional paid features in future, we will update these Terms and any applicable purchase and refund rules.

6. Advertising

The Game may offer optional rewarded ads (for example, to reveal a hint or continue a run). These are always your choice and never required to play. Ads are served by third-party partners and are subject to their terms; we are not responsible for the content of third-party ads.

7. Suspension & termination

We may suspend, ban, restrict, reset scores, or terminate your account or access to the Game — with or without notice — if you breach these Terms, cheat or attempt to, or where necessary to protect the Game, our users, or Dodgeye. You may stop using the Game at any time and may request deletion of your account. On termination, your licence ends and your progress and virtual items may be lost. Sections that by their nature should survive (such as intellectual property, disclaimers, limitation of liability, and governing law) will survive.

8. Updates & availability

We may update, change, add, or remove features, levels, or content, and we may release updates you need to install to keep playing. We may also suspend or discontinue the Game or any feature at any time. The campaign is designed to be playable offline, but online features (sync, leaderboards, the Daily Challenge, and ads) require a connection and may be unavailable at times. We do not guarantee uninterrupted or error-free operation.

9. Intellectual property

Dodgeye, the Watcher, the logo, artwork, characters, audio, and software are owned by Dodgeye and protected by intellectual-property laws. Dodgeye and the Watcher are our trademarks. Except for the licence to play granted above, you receive no rights to our intellectual property, and you may not copy, modify, distribute, or create derivative works from it without our written permission.

10. App stores & third-party terms

Your use of the Game is also subject to the rules of the app store you obtained it from (Apple App Store or Google Play). Where you obtained the Game from the Apple App Store, the following also apply: (a) these Terms are between you and Dodgeye only, not Apple, and Apple is not responsible for the Game or its content; (b) your licence is limited to use on Apple-branded devices you own or control, under the App Store Usage Rules; (c) Dodgeye is solely responsible for the Game and any maintenance or support, and Apple has no such obligation; (d) in the event the Game fails to conform to any applicable warranty, you may notify Apple and Apple may refund any purchase price paid, and to the maximum extent permitted by law Apple has no other warranty obligation; (e) Dodgeye (not Apple) is responsible for addressing any claims relating to the Game, including product-liability, legal/regulatory, consumer-protection, and intellectual-property claims; and (f) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Disclaimers

The Game is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that the Game will be uninterrupted, secure, or error-free, or that scores, rankings, or data will always be accurate or preserved.

12. Limitation of liability

To the maximum extent permitted by law, Dodgeye and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, progress, virtual items, or goodwill, arising from your use of (or inability to use) the Game. To the extent liability cannot be excluded, our total liability to you is limited to the amount you paid us for the Game in the 12 months before the claim, or, if you paid nothing, USD 25. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.

13. Governing law & disputes

These Terms are governed by the laws of India, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in India for any dispute, except that if you are a consumer, you may also be entitled to bring proceedings in the courts of the country where you live, and to rely on mandatory consumer-protection rules that apply there.

14. General

These Terms and the Privacy Policy are the entire agreement between you and Dodgeye about the Game. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver of it. You may not assign these Terms; we may assign them to an affiliate or successor. We may update these Terms from time to time — we will change the “Last updated” date above and, for material changes, give more prominent notice; continuing to play means you accept the updated Terms.
